1. Acceptance of Terms

By downloading, installing, or using the Songy Wongy application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Pure AI, LLC ("we," "our," or "us").

2. License Grant

The App is licensed, not sold, to you. We grant you a non-transferable license to use the App on any devices that you own or control. You may not reverse-engineer, disassemble, or attempt to derive the source code of the App, except as permitted by applicable law.

3. Eligibility

You must be at least 13 years old to use Songy Wongy. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. Description of Service

Songy Wongy is an AI-powered music generation application that allows users to create original songs based on text prompts and style preferences. The App offers a free trial (one song without account creation) and subscription plans for continued use.

5. User Accounts

To access certain features beyond the free trial, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

6. Subscriptions and Payments

Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing:

• You authorize recurring charges to your payment method
• Subscriptions automatically renew unless cancelled before the renewal date
• You can manage or cancel subscriptions through your device's app store settings
• Refunds are subject to Apple/Google's refund policies
• Credits granted by your subscription do not roll over between billing periods unless otherwise stated

7. Ownership of Generated Content

Your Content: You retain full ownership and rights to all songs you generate using Songy Wongy. You may use your generated songs for any purpose, including commercial use, without additional licensing fees.

Our Platform: We retain all rights to the App, its design, features, underlying technology, and AI models. Your use of the App does not grant you any ownership rights in the platform itself.

8. Acceptable Use

You agree not to use Songy Wongy to:

• Generate content that is illegal, harmful, threatening, abusive, or hateful
• Infringe on any third party's intellectual property rights
• Attempt to reverse engineer, hack, or compromise the App's security
• Use automated systems to access the App without permission
• Resell or redistribute the service without authorization
• Violate any applicable laws or regulations

9. AI-Generated Content Disclaimer

Songs generated by Songy Wongy are created using artificial intelligence. While we strive for originality, we cannot guarantee that generated content will not unintentionally resemble existing works. You are responsible for reviewing your generated content before use and ensuring it does not infringe on others' rights.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue features at any time.

11. Limitation of Liability

To the maximum extent permitted by law, Pure AI, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, secure, or meet your specific requirements.

13. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You can delete your account at any time through the app settings. Upon termination, your right to use the App ceases immediately.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
